Michigan is trying to cut down on the number of DUI arrests, accidents and deaths. Michigan law makes it illegal to drive under the following conditions:

  • While intoxicated by alcohol, drugs or prescription medications
  • While driving with a blood alcohol content (BAC) of 0.08 or higher
  • With any amount of cocaine or other Schedule I drug in your body
  • While under 21 years old and driving with a BAC of 0.02 or higher

There are four types of criminal charges you could face:

  • Operating while visibly impaired. This means that your ability to drive a vehicle was impaired by drugs or alcohol. Your BAC does not have to be 0.08.
  • Operating while intoxicated. This means that your ability to drive was impaired, your BAC was 0.08 or above or you have committed an aggravated DUI of 0.17 or above.
  • Operating with a Schedule I drug or cocaine. Having even the tiniest amount of these drugs in your system while driving can have you facing criminal charges.
  • Under age 21 operating with any bodily content. Michigan’s zero tolerance policy prohibits those not old enough to drink (under the age of 21) from having any alcohol in their body. Even those with a BAC of 0.02 can face criminal charges.
