Not everyone who has been drinking and then gets behind the wheel of a vehicle is necessarily guilty of driving under the influence. In other instances even if a person has had too much to drink, officers fail to follow all the proper procedures when they stop a driver. In both cases, people in these situations should stand up for their rights. Being arrested for drinking and driving is always a serious matter so its important to have an attorney to help you understand what you are up against and one that will fight for you.
A Detroit man is facing several charges, including DUI, after an officer pulled him over because his stereo was reportedly extremely loud. According to reports, the officer claims that even though he was more than 100 feet behind the man’s vehicle he could still hear his stereo clearly. The officer decided to pull the man over but when he asked for the man’s identification the man allegedly became upset and hostile. According to the officer, the man began yelling profanities, as the officer continued to request his license. The officer also claims that while the man was yelling he noticed the smell of alcohol on his breath.
At that point, the officer reportedly turned off the 23-year-old man’s engine and ordered him to get out of the car. When he did finally get out of the car, the officer arrested him for failure to obey. After arriving at the station officers administered a breath test to the man and according to police reports his blood-alcohol percentage came back at 0.17, which is close to Michigan’s “super drunk” law threshold. Authorities charged the man with drunk driving. He also received a ticket for playing his stereo too loud.
